Welcome to Swift

These Terms of Service (“Terms”) are a legal agreement between you and Swift (“Swift,” “we,” “us,” or “our”) governing your access to and use of our websites, apps, content, courses, tools, widgets, APIs, and related services (the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Education-Only, Not Advice. Swift provides financial education and general information only. We do not provide financial, investment, tax, accounting, or legal advice and we are not your advisor or fiduciary. Nothing herein is a recommendation or a solicitation to buy/sell any financial product. You are solely responsible for your decisions—consult qualified professionals for advice tailored to you.

1) Who We Are — Status Disclosures
  • Not a bank or lender. We are not a bank, lender, credit-card issuer, or depositary institution and are not FDIC-insured. Financing/BNPL and payment services accessible via Swift are provided by independent third parties under their own terms and disclosures.
  • Not a broker-dealer or investment adviser. We do not effect transactions in securities/commodities, do not provide investment advisory services, and do not offer or sell securities or derivatives.
  • Not a money transmitter for user funds. We do not custody, transmit, or hold user funds. Any wallets, payouts, or rails are provided by third-party processors under their terms.
  • Not a credit-repair organization. We are not subject to CROA as a credit-repair org and make no promises to improve credit scores or remove accurate, timely, and verifiable data from credit reports. Our tools/templates are educational self-help resources.
2) Services Description
  • Educational Content & Courses: finance/credit literacy, budgeting, credit reports, and related topics.
  • Tools & Calculators: estimators/simulators for learning. Results are illustrative only and not guarantees of any outcome.
  • Affiliate Marketplace Access: links to third-party retailers/marketplaces (e.g., Amazon, Temu, TikTok Shop). We may earn commissions on qualifying purchases.
  • BNPL & Financial Offers (Third-Party): access to offers from independent providers. Swift is not a party to those contracts.

We may add, modify, or discontinue the Services at any time without liability, consistent with Section 17 (Changes).

3) Eligibility & Accounts
  • You must be at least 18 (or the age of majority where you live) to use financial features. Under-18 users may access general educational content only with parent/guardian consent and supervision.
  • You agree to provide accurate information, keep it updated, safeguard your credentials, and accept responsibility for all activity under your account.
  • We may suspend/terminate accounts for violations, fraud, risk, or security concerns.
4) Education-Only; No Advice or Fiduciary Relationship
  • All content/tools are for educational purposes only. We do not provide personalized financial, investment, tax, accounting, or legal advice.
  • Your use of the Services does not create any advisor, attorney-client, or fiduciary relationship with Swift.
  • Consult licensed professionals before making decisions about credit, loans, investments, or taxes.
5) Third-Party Services & Offers
  • Independent providers. Retailers, BNPL/financing providers, credit-building services, and payment processors are independent and governed by their own terms, privacy policies, disclosures, fees, and eligibility criteria.
  • No control / No responsibility. We do not control third-party content, pricing, fees, approvals/denials, delivery, returns, data practices, or support and are not liable for their acts/omissions.
  • Affiliate disclosure. We may receive compensation when you click links or make purchases. As an Amazon Associate, Swift earns from qualifying purchases. Prices/availability may change and may differ from displays.
6) Credit & BNPL Disclosures (Risks)
  • Credit impact & fees. Financing products may involve fees, interest, late charges, and could affect your credit. BNPL providers decide eligibility and reporting per their policies.
  • No outcome guarantees. We do not guarantee approval, limits, rates, savings, a specific credit score, or any particular result.
  • Self-help only. Use of templates (e.g., disputes) is at your discretion. Do not submit false information to creditors, CRAs, or regulators.
7) User Responsibilities & Acceptable Use
  • No unlawful, deceptive, fraudulent, harassing, infringing, harmful, or abusive use.
  • No false identity, income, or credit information; no chargeback abuse; no manipulation of credit systems.
  • No copying, scraping, crawling, reverse engineering, bypassing access controls, or unauthorized bots.
  • No malware or illegal, infringing, defamatory, or obscene content.
  • Comply with applicable laws (consumer-finance, privacy, IP, export, sanctions).
8) Subscriptions, Billing, Trials, & Refunds
  • Plans & Auto-Renewal. Paid plans (Basic, Bronze, Gold, Diamond) bill in advance and auto-renew until canceled. You authorize recurring charges and applicable taxes.
  • Trials/Promos. Trials convert to paid unless canceled before renewal; eligibility is at our discretion.
  • Cancellations. You can cancel future renewals anytime in account settings; effective at period end. No proration.
  • Refunds. Fees are non-refundable unless required by law or by a written guarantee we provide. We may offer a one-time courtesy refund at our discretion, especially for first-time users. Third-party purchases follow that provider’s policy.
  • Chargebacks. Invalid disputes may result in suspension/termination and collection.
9) Taxes

You are responsible for all applicable taxes (e.g., sales, use, VAT, GST) arising from your purchases or use of the Services, excluding taxes based on our net income. We may collect and remit taxes where required by law. We do not provide tax advice—consult a qualified tax professional.

10) Ownership; License to Use
  • Our IP. The Services (including text, graphics, logos, trademarks, course content, software, and compilations) are owned by or licensed to Swift and protected by IP laws.
  • License. We grant you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial, educational use in accordance with these Terms.
  • Restrictions. You may not reproduce, distribute, publicly display, modify, create derivative works of, or exploit the Services except as expressly permitted.
11) User Content; Feedback
  • Your content. If you submit content, you grant Swift a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and improve the Services.
  • Responsibility. You have the necessary rights and your content does not violate law or others’ rights.
  • Feedback. Suggestions are licensed to Swift perpetually, irrevocably, and royalty-free.
12) Copyright; DMCA

If you believe content infringes your copyright, send a notice compliant with 17 U.S.C. §512(c)(3) to our designated agent at info@myswiftshop.comwith the required information. We may remove content and terminate repeat infringers.

13) Privacy; Data Practices

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Services, you consent to our data practices as described there and to receiving service-related communications.

14) Disclaimers
  • Education-Only. We are providing educational and informational content only. No financial, investment, tax, accounting, or legal advice.
  • No Warranties. The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including fitness, accuracy, or non-infringement. Estimates/calculators are illustrative only.
  • Third-Party Services. We make no warranties for third-party products/services; your dealings are solely between you and them.
15) Limitation of Liability
  • No indirect damages. We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, data, goodwill, or business interruption), even if advised of the possibility.
  • Cap. Our aggregate liability for claims related to the Services will not exceed the greater of (a) amounts you paid to Swift in the preceding 12 months, or (b) $100.
  • Some jurisdictions do not allow certain limitations; where not allowed, our liability is limited to the maximum extent permitted by law.
16) Indemnification

You agree to defend, indemnify, and hold harmless Swift and its affiliates, officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your willful misuse or unlawful use of the Services, your content, your violation of these Terms or applicable law, or your dealings with third parties, to the extent permitted by applicable law.

17) Changes to Services or Terms

We may modify or discontinue all or part of the Services at any time. We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., site posting or email). Your continued use after changes become effective constitutes acceptance.

18) Term; Suspension; Termination

These Terms remain in effect until terminated. We may suspend or terminate your access immediately for violations, risk of harm, suspected fraud, or compliance reasons. Sections intended to survive (including 4, 5, 6, 7, 8–11, 14–22) will survive termination.

19) Governing Law; Arbitration; Class-Action Waiver
  • Governing Law. Florida law (without regard to conflict-of-laws rules) and the Federal Arbitration Act (FAA) govern these Terms.
  • Binding Arbitration. Any dispute arising out of or relating to the Services or these Terms will be resolved by binding, individual arbitration administered by JAMS (or AAA) under its rules. Judgment on the award may be entered in any court of competent jurisdiction.
  • Class/Jury Waiver. You and Swift waive the right to a jury trial and to participate in class/collective/representative actions. Disputes must be brought individually.
  • Small Claims & Opt-Out. Either party may bring qualifying claims in small-claims court. You may opt out of arbitration within 30 days of first accepting these Terms by emailing an opt-out notice to info@myswiftshop.com with your name, account email, and a clear statement that you are opting out.
20) Export Controls; Sanctions

You may not use the Services if you are in a U.S.-embargoed country or on a U.S. government list of prohibited or restricted parties. You agree to comply with U.S. export and sanctions laws. If you access Swift from outside the United States, you are solely responsible for complying with local laws and regulations.

21) Notices; Electronic Communications

You consent to receive notices and disclosures electronically. We may communicate via the Services, email, or other electronic means you provide. Keep your contact info current.

22) Miscellaneous
  • Entire Agreement. These Terms plus referenced policies (e.g., Privacy Policy) are the entire agreement.
  • Severability. If a provision is unenforceable, the rest remain in effect.
  • No Waiver. Failure to enforce is not a waiver.
  • Assignment. You may not assign without our consent. We may assign in connection with merger, acquisition, or asset sale.
  • Force Majeure. We are not liable for delays or failures to perform due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, cyberattacks, telecommunications failures, power outages, labor strikes, regulatory changes, acts of war or terrorism, or government restrictions.
